1. Definition of terms

1.1. The Guest: The Guest (“you”,“they”) refers directly and specifically to the undersigning party that

wishes to participate in the Activity and agrees to the terms and conditions set forth herein

1.2. The Great Expedition Company: The team organising The Great Expedition Company (“us”,“we”,“our”), their affiliates, associates and partners from hereon is referred to as The GEC

1.3. The Contractor: S/V Linden their affiliates, associates, and partners who are providing a

sub-contracted service to The GEC from hereon is referred to as the Contractor

1.4. The Party/Parties: The Guest(s), The GEC and the Contractor and their affiliates, associates and

partners collectively are hereon referred to as the Party or the Parties

1.5. The Activity: The Activity in question from hereon mentioned as the Activity refers to the itinerary

of The Great Expedition Company which can be read in full detail on the website here

1.6. The Services: The necessary requirements due from both The GEC and the Contractor in order to

fulfil the Activity will hereon in be referred to as the Services

1.7. The Agreement: The following terms and conditions form the basis of your contract with The GEC,

their affiliates, associates and partners, will hereon in be referred to as the Agreement

The following Agreement sets out our joint respective rights and obligations between all Parties. The Guest must

read and understand this document in full before booking. These terms and conditions (T&C) will form the basis

of the contract between you (the Guest) and us (The GEC)

1.8. This document sets out the general terms and conditions involving Joseph Mattos-Hall of

www.greatexped.com trading as The Great Expedition Company Ehf

1.9. The GEC reserves the right to make reasonable changes to the T&C as and when necessary (for

instance, in the case of a change in the applicable laws or regulatory requirements). Such changes

will take effect when the updated T&C are formally sent to the Guest

2. Terms of Agreement

2.1. The terms of this Agreement will begin on the date on which the Guest makes the first deposit

payment and will remain in full force and effect until the completion of the Activity and Services,

subject to earlier termination as provided in this Agreement

2.2. All Parties agree to do everything necessary to ensure that the terms of this Agreement are met.

2.3. This Agreement will ensure to the benefit of and be binding on all the Parties and their respective

heirs, executors, administrators and permitted successors and assigns

3. Jurisdiction

3.1. Icelandic law will exclusively govern your contract with The GEC and subsequently the Contractor

3.2. The legal system of Iceland shall have exclusive jurisdiction to adjudicate upon any dispute or claim

that arises out of or in connection with this agreement or its subject matter or formation (including

non-contractual disputes and claims)

3.3. Danaish Maritime Laws will govern S/V Linden

4. Booking Procedure

4.1. Your booking will be confirmed by email after an initial deposit or full payment is made

4.2. The action of completing a deposit or payment in full confirms that you agree that you will be

making an offer to us. The GEC will contact you via email to confirm:

(a) the total price of the contract

(b) the date that your remaining deposit is due

(c) details of the payment plan

4.3. By making a booking, The GEC confirms that they are authorised to act on behalf of the Guest

4.4. It is the responsibility of the Guest to ensure that they have read and agreed to all relevant T&C

stated hereon

4.5. The GEC reserves the right to correct any errors in the confirmation email as soon as we become

aware of them, and formally inform the Guest of any changes to review

4.6. Upon final confirmation of booking, the Guest assumes full responsibility to arrange the necessary

flights and transport to support their inbound and outbound journey

5. Pricing

5.1. The GEC reserves the right to change the price of your booking before your booking is confirmed.

The GEC inform you of any such changes

5.2. The GEC reserves the right to correct pricing errors after confirmation

5.3. Prices do include:

5.3.1. All meals on board (lunch on day 1 through to breakfast on day 8)

5.3.2. Accommodation aboard (one bed per person based on shared accommodation)

5.3.3. Additional guided expeditions to the shore via Zodiac supplied by the Contractor

5.3.4. Air fare(s) from Reykjavik, Iceland to and from Constable Point Airport or single airfare from Constable Point in the case of an expedition with a crossing

5.4. Prices do not include:

5.4.1. The return air transport of the Guest to and from Iceland from their home country

5.4.2. Personal travel insurance for the Guest and their possessions

5.4.3. Food outside of the Activity agreement

5.5. Currency: except as otherwise stated in this Agreement, all monetary amounts referred to in this

Agreement are in EUR (Euros)

5.6. Additional alcoholic bevereidges bought onboard the vessels will be charged in Danish Krona DKK

or Euros EUR

6. Payments

6.1. The Guest will receive an invitation to secure a place on the Activity by way of an invoice

6.2. The GEC will detail the payment due date(s) in the confirmation email

6.3. Failure to pay an instalment on time gives The GEC the right to cancel the booking without a

refund. If you are likely to be unable to make a payment on time you must contact The GEC as

soon as possible to request an extension to the relevant payment due date. If such an extension is

agreed, The GEC will communicate this to you in writing

6.4. A contract will automatically arise between you and The GEC as soon as the first payment is

made, granting both parties respective duties and obligations under that contract

7. Postponement Terms

Guarantee from The GEC relating to any postponements:

7.1. If there are any complications with travelling or uncertainties arising that may impact our ability to

lead and deliver the Activity you have paid up for, it may be necessary for The GEC to postpone

the Activity until 2027 at no additional cost to the Guest

7.2. Upon Clause 7.1. coming into effect, the Guest is entitled to request a 100% refund, minus any

processing fees for a credit card or wire transfer, from The GEC

7.3. Upon Clause 7.2. coming into effect, the Guest must request a 100% refund in writing to The GEC

no more than six months prior to the departure date of the newly postponed Activity

Postponement by the Guest:

7.4. Not considering Clause 7, the Guest is entitled to request a postponement in the Activity no more

than thirty days prior to the departure date of the Activity. In such an event, the Guest must fulfil

the remaining balance of the invoice in full to confirm the postponement agreement

7.5. The GEC cannot accommodate a request, nor refund of any payments received to date, to

postpone the Guest’s participation in the Activity any later than sixty days prior to the departure

date of the Activity

8. Cancellation and Variation Policies

Variations by The GEC:

8.1. The Guest will be notified as soon as reasonably possible if significant changes to your booking are

needed. In this instance, the Guest may choose to:

8.1.1. cancel the booking and receive a 100% refund of all payments received to date, minus any

processing fees for a credit card or wire transfer

8.1.2. agree to and accept the changes in variation

Cancellation by The GEC:

8.2. Full cancellations without a prospect of postponement have never happened to date, but in the

unlikely event that this occurs then the Guest will be fully refunded from The GEC, minus any

processing fees for a credit card or wire transfer

8.3. Flights, accommodation, food, visas, and other incidental expenses for the intended trip must be

claimed via the Guests own comprehensive travel insurance, for which it is the sole responsibility of

the Guest to ensure is valid for their travel and destination

8.4. The GEC reserves the right to cancel your booking without any refund if you do not meet your

obligations under Clause 6.3 to pay the remainder of your invoice by the specified due date

8.5. If the Activity needs to be cancelled due to not meeting the minimum number of participants, the

Guest will be fully refunded, minus any processing fees for a credit card or wire transfer

Cancellation by Force Majeure:

8.6.

"Force majeure"

means any event which The GEC and/or the Contractor of the service(s) in

question could not, even with all due care, foresee or avoid. Examples of such situations include

(but are not limited to) dangerous weather conditions, fire, natural disaster, industrial actions, war,

riots, epidemic and other force majeure

8.7. In the event of force majeure at the Guests

origin, we regret we cannot accept liability or pay any

compensation where the performance or prompt performance of our obligations under our contract

with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any

nature as a result of force majeure

8.8. In the event of force majeure occurring at the destination, the Contractor is obliged to substitute an

alternate vessel suitable for The GEC in accordance with this Agreement

8.9. If the delivery of the vessel or an alternate vessel has not been performed by the Contractor within

one day after the specified date, this Agreement may be cancelled by The GEC and any deposits

or amounts therefore paid shall be returned to the Guest

Cancellation by the Guest:

8.10. If the Guest decides to cancel their booking then they must promptly inform The GEC in writing

8.11. If the Guest cancels their booking, the following minimum cancellation charges will apply, as a

percentage of the total booking cost:

agreeing to participate

8.11.2. 50% of the total amount if the cancellation is made after making the payment and

agreeing to participate and less than one hundred and twenty days prior to departure

8.11.3. 75% of the total amount if the cancellation is made after making the payment and

agreeing to participate and less than ninety days prior to departure

8.11.4. 100% of the total amount if cancellation is made after making the payment and agreeing

to participate and less than sixty days prior to departure

9. Vessel Specifications

9.1. The Guest can find specifications, measurements, inventories, and other data relating to the vessels

on The GEC website and in the information pack provided by Joseph Mattos-Hall in his capacity as

Expedition Leader

9.2. Vessel images are only intended to give a general idea of the type and ambiance of the vessel you

will be sailing on.

10. Contractors’ Terms

10.1. The GEC is led in association with S/V Linden, the Contractor, who retain their own T&C

10.2. In providing the Activities under this Agreement it is expressly agreed that the Contractor is acting

as an independent contractor to The GEC and not as an employee

10.3. The Contractor and the Guest acknowledge that this Agreement does not create a partnership or

joint venture between them and is exclusively a contract for service which is managed by The GEC

10.4. The GEC makes no representation regarding any vessel’

s seaworthiness or the state of any ancillary

equipment. Such representations and liability may only be made by the Contractor

10.5. Except as otherwise provided in this Agreement, the Contractor will provide at the Contractor’s own

expense, any and all tools, machinery, equipment, supplies, workwear and any other items or parts

necessary to deliver the Services of the Activity in accordance with the Agreement

10.6. Except as otherwise provided in this Agreement, the Contractor will have full control over working

time, methods, and decision making in relation to the provision of the Services in accordance with

the Agreement

10.7. The Contractor will work autonomously and not at the direction of the Guest or The GEC.

However, the Contractor will be responsive to the reasonable needs and concerns of the Guest and

The GEC

10.8. The Contractor will not voluntarily, or by operation of law, assign or otherwise transfer its

obligations under this Agreement without the prior written communication to The GEC

11. Travel Insurance Stipulation

11.1. The GEC does not sell or organise travel insurance for this Activity

11.2. The Guest must obtain travel insurance before embarking on this Activity. It is a condition of your

booking that you have a suitable travel insurance policy in place

11.3. The Guest must ensure that their insurance policy covers adventurous activities such as sailing in the

Arctic regions. Please read your policy carefully to ensure it complies with this requirement

11.4. The Guest must take out a policy of insurance in order to cover you for sailing on traditional boats

and tall ships in territorial or international waters as appropriate: against the cost of cancellation

by you; cancellation of the Activity by force majeure; logistical difficulty which may prevent you

from reaching the the starting point of the Activity at the correct time; the cost of assistance

(including repatriation) in the event of accident or illness; loss of baggage and money; and other

expenses

11.5. The Guest is strongly advised to have personal travel insurance for the possessions that the Guest

seeks to bring with them, such as camera equipment and other articles of high value

11.6. The GEC strongly advises comprehensive travel insurance for all participants to cover contingencies

and factors outside of the reasonable control of the Guest that may affect their activity to

participate in the Activity

11.7. The GEC accepts no liability for those who travel without travel insurance in breach of Clause 11.2.

12. Medical Liabilities

12.1. If the Guest has a pre-existing medical condition, mobility problem or disability which may affect

your participation in the Activity, then the GEC may require a doctor

s certificate or other

documentation to ascertain whether we can accommodate your needs effectively

12.2. You must inform and provide The GEC with any necessary and useful information concerning all

health challenges which you think you will or might experience during the Activity

12.3. The Guest will assume sole responsibility for the care of any pre-existing health conditions they have

which will or might affect their ability to participate in the Activity either before or during

2023 Service Terms and Conditions - Greenland - The Great Expedition Company 412.4. If you take medication or have health challenges in cold climate conditions, then you must ensure

that your insurance and/or medical provider can support you with any claims for medical cover

12.5. The Guest acknowledges that the consequences of their known medical liability is entirely out of the

scope of The GEC and should be managed solely by the Guest and their chosen insurance/medical

provider

12.6. If the Guest needs medical treatment as a result of their participation in this Activity, travel to and

from the Activity (including air travel), or any events incidental to this Activity, then the Guest

agrees to be financially responsible for any costs incurred as a result of such treatment

13. Transport

13.1. Your booking doesnot include transport to and from your home country, or any other type of

transport not mentioned or included in the itinerary of the Activity

14. Passports and Visas

14.1. Greenland requires citizens of some countries to carry a visa. The GEC cannot help you to obtain

the correct passports, visas, or other documentation that you might need to fulfil the booking and

participate in the activity

14.2. It is solely the responsibility of the Guest to ensure that they have the correct documents to enter

Greenland

15. Special Requests

15.1. Unless and until specifically confirmed, all special requests are subject to availability

15.2. Failure to meet any special request will not be a breach of contract on the part of the GEC

15.3. If the Guest has any special request, you must advise The GEC before confirming your booking

15.4. Although The GEC will endeavour to pass any reasonable requests on to the Contractor, we regret

that we cannot guarantee any request will be met unless we have specifically confirmed it in writing

to the Guest

16. Mother Nature

16.1. Wildlife is never baited. Therefore, the Guest must understand that wildlife is unpredictable and

never guaranteed

16.2. The GEC and the Contractor will endeavour to do their very best to work with local sources and

guides to have intel as to where to find and locate wildlife

16.3. Quality and quantity are not guaranteed concerning wildlife sightings and the Guest may not

request a partial or full refund depending on the lack of wildlife opportunities

17. Behaviour & Conduct

17.1. If at any point during the Activity, whilst preparing to depart, while on board a vessel or on

mainland Greenland, your behaviour poses as a danger to you or those around you, causes or is

likely to cause damage to people or property, breaches any local law, causes or is likely to cause a

public nuisance, The GEC has the right to inform the Contractor about dangerous behaviour which

may result in terminating this Agreement and removing the Guest from the Activity in its entirety

with no obligation to issue a partial or full refund

18. Criminal Intent & Activity

18.1. Criminal and illegal activity of any genre will not be tolerated throughout the duration of the

Activity

18.2. If a passenger commits a crime onboard the vessel, the Contractor is obligated by law to announce

the incident to Norwegian authorities. The captain must immediately sail to the nearest village and

follow directions in coordination with relevant authorities according to the nature of the crime

18.3. If a passenger commits a crime on mainland Greenland, or at any point at which the Activity is in

suit, The GEC is obligated by law to announce the incident to local authorities and await further

instruction

18.4. The same procedure aforementioned in Clauses 18.2 and 18.3 will be followed concerning the death

of a passenger, either by natural, accidental or criminal causes

19. Privacy

Data protection:

19.1. The GEC respects the privacy of the Guest and does not tolerate nor engage in spam. We will

never sell, rent, lease or give away your information (name, address, email, etc.) to any third party

Image collection and use:

19.2. The GEC and their respective guides/photographers reserve the right to take photographs or

videos during the operation of any expedition or part thereof and to use the resulting photography

for commercial and/or promotional purposes with ownership of all rights in connection with such

media

19.3. By making a booking with The GEC, the Guest agrees to allow their images to be used in such

photography

19.4. Guests who prefer that their image not be used are asked to express this request in writing to The

GEC prior to the Activity commencing

20. Responsibility of The GEC

Reasonable care to the Guest:

20.1. The GEC have a duty to fulfil their obligations to the Guest concerning safety in the Activity

20.2. The GEC accepts responsibility for using reasonable care and skill to ensure that the Activity is

supplied as described in our promotional material, and that services offered and carried out are of

a standard reasonably expected by a person skilled in offering and carrying out such services

20.3. The GEC will take reasonable care to ensure that reputable Contractors and other third

parties provide the services that make up the expedition as expected

20.4. Our obligations, and those of our Contractors, in respect of reasonable care, will follow the

local law or, in the absence of this, local custom. Compliance with any applicable regulatory

requirements will constitute proper performance on the part of The GEC in the discharge of our

duties and obligations under these T&C

Liability to the Guest:

20.5. The GEC acts in good and honest faith and disclaims responsibility for any loss, damage,

accidents, illness or changes in schedules caused by weather, strikes or any other irregularity outside

The GEC’s control

Compensation claims:

20.6. The promises we make to you about the services we have agreed to provide or arrange as part

of our contract - and the laws and regulations of the country in which your claim occurred - will be

used as the basis for deciding whether the services in question had been properly provided

20.7. If the particular services which gave rise to the claim or complaint complied with local laws and

regulations applicable to those services at the time, the services will be treated as having been

properly provided. This will be the case even if the services did not comply with the laws and

regulations of Iceland which would have applied had those services been provided in Iceland

Complaints:

20.8. The GEC maintains the highest standards in creating an itinerary and selecting the

Contractors all in good faith based on prior experiences

20.9. The Guest is welcome to address any issues directly with The GEC as soon as they arise. We

will then attempt to find an appropriate solution. Please allow us a reasonable opportunity to

rectify the problems you are experiencing

20.10. Failure to register a complaint promptly is likely to affect your right to compensation

21. Severability

21.1. If any provision or part of a provision, of these conditions in this Agreement is found by any court

or authority of competent jurisdiction to be unlawful, otherwise invalid or unenforceable, such

provision or part-provision will be struck out of these conditions and the remainder of the conditions

will apply as if the offending provision or part-provision had never been agreed

22. Waiver of liability

22.1. By signing this Agreement – by way of paying the deposit – the Guest is voluntarily participating in

the Activity

22.2. The Guest acknowledges that there are risks associated with your participation in this Activity,

not limited to but specifically being on land shared with polar bears, such as physical and/or

psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death

or economic loss. These injuries or outcomes may arise from the Guests’own or other’s actions,

inactions, or negligence. Nonetheless, the Guest assumes all risks of their participation in this

Activity

22.3. The Guest agrees to hold The GEC harmless from any and all claims, loss or damage to your

personal property, liabilities and costs, including attorney’s fees, as a result of your participation in

this Activity23.

23. Indemnification

23.1. Except to the extent paid in settlement from any applicable third party insurance policies, and to

the extent permitted by applicable law, all Parties agrees to indemnify and hold harmless the other

Party, and assigns against any and all claims, losses, damages, liabilities, penalties, punitive

damages, expenses, reasonable legal fees and costs of any kind or amount whatsoever, which result

from or arise out of any act or omission of the indemnifying party that occurs in connection with

this Agreement. This indemnification will survive the termination of this Agreement

23.2. Your confirmed booking will automatically affirm that you have had the opportunity to read,

agree to, and accept the following terms and conditions outlined in great detail throughout this

document. All queries and/or objections to any conditions must be clarified with The GEC prior to

securing your booking

refund. If you are likely to be unable to make a payment on time you must contact The GEC as

soon as possible to request an extension to the relevant payment due date. If such an extension is

agreed, The GEC will communicate this to you in writing

6.4. A contract will automatically arise between you and The GEC as soon as the first payment is

made, granting both parties respective duties and obligations under that contract

7. Postponement Terms

Guarantee from The GEC relating to any postponements:

7.1. If there are any complications with travelling or uncertainties arising that may impact our ability to

lead and deliver the Activity you have paid up for, it may be necessary for The GEC to postpone

the Activity until 2027 at no additional cost to the Guest

7.2. Upon Clause 7.1. coming into effect, the Guest is entitled to request a 100% refund, minus any

processing fees for a credit card or wire transfer, from The GEC

7.3. Upon Clause 7.2. coming into effect, the Guest must request a 100% refund in writing to The GEC

no more than six months prior to the departure date of the newly postponed Activity

Postponement by the Guest:

7.4. Not considering Clause 7, the Guest is entitled to request a postponement in the Activity no more

than thirty days prior to the departure date of the Activity. In such an event, the Guest must fulfil

the remaining balance of the invoice in full to confirm the postponement agreement

7.5. The GEC cannot accommodate a request, nor refund of any payments received to date, to

postpone the Guest’s participation in the Activity any later than sixty days prior to the departure

date of the Activity

8. Cancellation and Variation Policies

Variations by The GEC:

8.1. The Guest will be notified as soon as reasonably possible if significant changes to your booking are

needed. In this instance, the Guest may choose to:

8.1.1. cancel the booking and receive a 100% refund of all payments received to date, minus any

processing fees for a credit card or wire transfer

8.1.2. agree to and accept the changes in variation

Cancellation by The GEC:

8.2. Full cancellations without a prospect of postponement have never happened to date, but in the

unlikely event that this occurs then the Guest will be fully refunded from The GEC, minus any

processing fees for a credit card or wire transfer

8.3. Flights, accommodation, food, visas, and other incidental expenses for the intended trip must be

claimed via the Guests own comprehensive travel insurance, for which it is the sole responsibility of

the Guest to ensure is valid for their travel and destination

8.4. The GEC reserves the right to cancel your booking without any refund if you do not meet your

obligations under Clause 6.3 to pay the remainder of your invoice by the specified due date

8.5. If the Activity needs to be cancelled due to not meeting the minimum number of participants, the

Guest will be fully refunded, minus any processing fees for a credit card or wire transfer

Cancellation by Force Majeure:

8.6.

"Force majeure"

means any event which The GEC and/or the Contractor of the service(s) in

question could not, even with all due care, foresee or avoid. Examples of such situations include

(but are not limited to) dangerous weather conditions, fire, natural disaster, industrial actions, war,

riots, epidemic and other force majeure

8.7. In the event of force majeure at the Guests

origin, we regret we cannot accept liability or pay any

compensation where the performance or prompt performance of our obligations under our contract

with you is prevented or affected by or you otherwise suffer any damage, loss or expense of any

nature as a result of force majeure

8.8. In the event of force majeure occurring at the destination, the Contractor is obliged to substitute an

alternate vessel suitable for The GEC in accordance with this Agreement

8.9. If the delivery of the vessel or an alternate vessel has not been performed by the Contractor within

one day after the specified date, this Agreement may be cancelled by The GEC and any deposits

or amounts therefore paid shall be returned to the Guest

Cancellation by the Guest:

8.10. If the Guest decides to cancel their booking then they must promptly inform The GEC in writing

8.11. If the Guest cancels their booking, the following minimum cancellation charges will apply, as a

percentage of the total booking cost:

agreeing to participate

8.11.2. 50% of the total amount if the cancellation is made after making the payment and

agreeing to participate and less than one hundred and twenty days prior to departure

8.11.3. 75% of the total amount if the cancellation is made after making the payment and

agreeing to participate and less than ninety days prior to departure

8.11.4. 100% of the total amount if cancellation is made after making the payment and agreeing

to participate and less than sixty days prior to departure

9. Vessel Specifications

9.1. The Guest can find specifications, measurements, inventories, and other data relating to the vessels

on The GEC website and in the information pack provided by Joseph Mattos-Hall in his capacity as

Expedition Leader

9.2. Vessel images are only intended to give a general idea of the type and ambiance of the vessel you

will be sailing on.

10. Contractors’ Terms

10.1. The GEC is led in association with S/V Linden, the Contractor, who retain their own T&C

10.2. In providing the Activities under this Agreement it is expressly agreed that the Contractor is acting

as an independent contractor to The GEC and not as an employee

10.3. The Contractor and the Guest acknowledge that this Agreement does not create a partnership or

joint venture between them and is exclusively a contract for service which is managed by The GEC

10.4. The GEC makes no representation regarding any vessel’

s seaworthiness or the state of any ancillary

equipment. Such representations and liability may only be made by the Contractor

10.5. Except as otherwise provided in this Agreement, the Contractor will provide at the Contractor’s own

expense, any and all tools, machinery, equipment, supplies, workwear and any other items or parts

necessary to deliver the Services of the Activity in accordance with the Agreement

10.6. Except as otherwise provided in this Agreement, the Contractor will have full control over working

time, methods, and decision making in relation to the provision of the Services in accordance with

the Agreement

10.7. The Contractor will work autonomously and not at the direction of the Guest or The GEC.

However, the Contractor will be responsive to the reasonable needs and concerns of the Guest and

The GEC

10.8. The Contractor will not voluntarily, or by operation of law, assign or otherwise transfer its

obligations under this Agreement without the prior written communication to The GEC

11. Travel Insurance Stipulation

11.1. The GEC does not sell or organise travel insurance for this Activity

11.2. The Guest must obtain travel insurance before embarking on this Activity. It is a condition of your

booking that you have a suitable travel insurance policy in place

11.3. The Guest must ensure that their insurance policy covers adventurous activities such as sailing in the

Arctic regions. Please read your policy carefully to ensure it complies with this requirement

11.4. The Guest must take out a policy of insurance in order to cover you for sailing on traditional boats

and tall ships in territorial or international waters as appropriate: against the cost of cancellation

by you; cancellation of the Activity by force majeure; logistical difficulty which may prevent you

from reaching the the starting point of the Activity at the correct time; the cost of assistance

(including repatriation) in the event of accident or illness; loss of baggage and money; and other

expenses

11.5. The Guest is strongly advised to have personal travel insurance for the possessions that the Guest

seeks to bring with them, such as camera equipment and other articles of high value

11.6. The GEC strongly advises comprehensive travel insurance for all participants to cover contingencies

and factors outside of the reasonable control of the Guest that may affect their activity to

participate in the Activity

11.7. The GEC accepts no liability for those who travel without travel insurance in breach of Clause 11.2.

12. Medical Liabilities

12.1. If the Guest has a pre-existing medical condition, mobility problem or disability which may affect

your participation in the Activity, then the GEC may require a doctor

s certificate or other

documentation to ascertain whether we can accommodate your needs effectively

12.2. You must inform and provide The GEC with any necessary and useful information concerning all

health challenges which you think you will or might experience during the Activity

12.3. The Guest will assume sole responsibility for the care of any pre-existing health conditions they have

which will or might affect their ability to participate in the Activity either before or during

2023 Service Terms and Conditions - Greenland - The Great Expedition Company 412.4. If you take medication or have health challenges in cold climate conditions, then you must ensure

that your insurance and/or medical provider can support you with any claims for medical cover

12.5. The Guest acknowledges that the consequences of their known medical liability is entirely out of the

scope of The GEC and should be managed solely by the Guest and their chosen insurance/medical

provider

12.6. If the Guest needs medical treatment as a result of their participation in this Activity, travel to and

from the Activity (including air travel), or any events incidental to this Activity, then the Guest

agrees to be financially responsible for any costs incurred as a result of such treatment

13. Transport

13.1. Your booking doesnot include transport to and from your home country, or any other type of

transport not mentioned or included in the itinerary of the Activity

14. Passports and Visas

14.1. Greenland requires citizens of some countries to carry a visa. The GEC cannot help you to obtain

the correct passports, visas, or other documentation that you might need to fulfil the booking and

participate in the activity

14.2. It is solely the responsibility of the Guest to ensure that they have the correct documents to enter

Greenland

15. Special Requests

15.1. Unless and until specifically confirmed, all special requests are subject to availability

15.2. Failure to meet any special request will not be a breach of contract on the part of the GEC

15.3. If the Guest has any special request, you must advise The GEC before confirming your booking

15.4. Although The GEC will endeavour to pass any reasonable requests on to the Contractor, we regret

that we cannot guarantee any request will be met unless we have specifically confirmed it in writing

to the Guest

16. Mother Nature

16.1. Wildlife is never baited. Therefore, the Guest must understand that wildlife is unpredictable and

never guaranteed

16.2. The GEC and the Contractor will endeavour to do their very best to work with local sources and

guides to have intel as to where to find and locate wildlife

16.3. Quality and quantity are not guaranteed concerning wildlife sightings and the Guest may not

request a partial or full refund depending on the lack of wildlife opportunities

17. Behaviour & Conduct

17.1. If at any point during the Activity, whilst preparing to depart, while on board a vessel or on

mainland Greenland, your behaviour poses as a danger to you or those around you, causes or is

likely to cause damage to people or property, breaches any local law, causes or is likely to cause a

public nuisance, The GEC has the right to inform the Contractor about dangerous behaviour which

may result in terminating this Agreement and removing the Guest from the Activity in its entirety

with no obligation to issue a partial or full refund

18. Criminal Intent & Activity

18.1. Criminal and illegal activity of any genre will not be tolerated throughout the duration of the

Activity

18.2. If a passenger commits a crime onboard the vessel, the Contractor is obligated by law to announce

the incident to Norwegian authorities. The captain must immediately sail to the nearest village and

follow directions in coordination with relevant authorities according to the nature of the crime

18.3. If a passenger commits a crime on mainland Greenland, or at any point at which the Activity is in

suit, The GEC is obligated by law to announce the incident to local authorities and await further

instruction

18.4. The same procedure aforementioned in Clauses 18.2 and 18.3 will be followed concerning the death

of a passenger, either by natural, accidental or criminal causes

19. Privacy

Data protection:

19.1. The GEC respects the privacy of the Guest and does not tolerate nor engage in spam. We will

never sell, rent, lease or give away your information (name, address, email, etc.) to any third party

Image collection and use:

19.2. The GEC and their respective guides/photographers reserve the right to take photographs or

videos during the operation of any expedition or part thereof and to use the resulting photography

for commercial and/or promotional purposes with ownership of all rights in connection with such

media

19.3. By making a booking with The GEC, the Guest agrees to allow their images to be used in such

photography

19.4. Guests who prefer that their image not be used are asked to express this request in writing to The

GEC prior to the Activity commencing

20. Responsibility of The GEC

Reasonable care to the Guest:

20.1. The GEC have a duty to fulfil their obligations to the Guest concerning safety in the Activity

20.2. The GEC accepts responsibility for using reasonable care and skill to ensure that the Activity is

supplied as described in our promotional material, and that services offered and carried out are of

a standard reasonably expected by a person skilled in offering and carrying out such services

20.3. The GEC will take reasonable care to ensure that reputable Contractors and other third

parties provide the services that make up the expedition as expected

20.4. Our obligations, and those of our Contractors, in respect of reasonable care, will follow the

local law or, in the absence of this, local custom. Compliance with any applicable regulatory

requirements will constitute proper performance on the part of The GEC in the discharge of our

duties and obligations under these T&C

Liability to the Guest:

20.5. The GEC acts in good and honest faith and disclaims responsibility for any loss, damage,

accidents, illness or changes in schedules caused by weather, strikes or any other irregularity outside

The GEC’s control

Compensation claims:

20.6. The promises we make to you about the services we have agreed to provide or arrange as part

of our contract - and the laws and regulations of the country in which your claim occurred - will be

used as the basis for deciding whether the services in question had been properly provided

20.7. If the particular services which gave rise to the claim or complaint complied with local laws and

regulations applicable to those services at the time, the services will be treated as having been

properly provided. This will be the case even if the services did not comply with the laws and

regulations of Iceland which would have applied had those services been provided in Iceland

Complaints:

20.8. The GEC maintains the highest standards in creating an itinerary and selecting the

Contractors all in good faith based on prior experiences

20.9. The Guest is welcome to address any issues directly with The GEC as soon as they arise. We

will then attempt to find an appropriate solution. Please allow us a reasonable opportunity to

rectify the problems you are experiencing

20.10. Failure to register a complaint promptly is likely to affect your right to compensation

21. Severability

21.1. If any provision or part of a provision, of these conditions in this Agreement is found by any court

or authority of competent jurisdiction to be unlawful, otherwise invalid or unenforceable, such

provision or part-provision will be struck out of these conditions and the remainder of the conditions

will apply as if the offending provision or part-provision had never been agreed

22. Waiver of liability

22.1. By signing this Agreement – by way of paying the deposit – the Guest is voluntarily participating in

the Activity

22.2. The Guest acknowledges that there are risks associated with your participation in this Activity,

not limited to but specifically being on land shared with polar bears, such as physical and/or

psychological injury, pain, suffering, illness, disfigurement, temporary or permanent disability, death

or economic loss. These injuries or outcomes may arise from the Guests’own or other’s actions,

inactions, or negligence. Nonetheless, the Guest assumes all risks of their participation in this

Activity

22.3. The Guest agrees to hold The GEC harmless from any and all claims, loss or damage to your

personal property, liabilities and costs, including attorney’s fees, as a result of your participation in

this Activity23.

23. Indemnification

23.1. Except to the extent paid in settlement from any applicable third party insurance policies, and to

the extent permitted by applicable law, all Parties agrees to indemnify and hold harmless the other

Party, and assigns against any and all claims, losses, damages, liabilities, penalties, punitive

damages, expenses, reasonable legal fees and costs of any kind or amount whatsoever, which result

from or arise out of any act or omission of the indemnifying party that occurs in connection with

this Agreement. This indemnification will survive the termination of this Agreement

23.2. Your confirmed booking will automatically affirm that you have had the opportunity to read,

agree to, and accept the following terms and conditions outlined in great detail throughout this

document. All queries and/or objections to any conditions must be clarified with The GEC prior to

securing your booking
